Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to Decree No. 127/2007/ND-CP dated August 1, 2007 of the Government detailing the implementation of a number of articles of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 78/2018/ND-CP dated May 16, 2018 of the Government amending and supplementing a number of articles of Decree No. 127/2007/ND-CP dated August 1, 2007 of the Government detailing the implementation of a number of articles of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 52/2022/ND-CP dated August 8, 2022 of the Government regulating the functions, tasks, powers and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Department of Science, Technology and Environment;

The Minister of Construction promulgates the Circular issuing the National Technical Regulation on building material products and goods.

Article 1. To promulgate together with this Circular the Technical Regulation QCVN 16:2023/BXD National Technical Regulation on building material products and goods.

Article 2. The Technical Regulation QCVN 16:2023/BXD shall take effect from January 1, 2024.

Article 3. To annul the Technical Regulation QCVN 16:2019/BXD National Technical Regulation on building material products and goods promulgated together with Circular No. 19/2019/TT-BXD dated December 31, 2019 of the Minister of Construction.

Article 4. Transitional provisions

1. For organizations and individuals manufacturing and importing building material goods that have been granted a Certificate of Conformity to the Technical Regulation QCVN16:2019/BXD and the Certificate is still valid, they are allowed to use the Certificate of Conformity and conformity mark until the expiration of that Certificate.

2. For organizations that have been designated to certify conformity and test building material products and goods according to the Technical Regulation QCVN 16:2019/BXD, they are allowed to continue to carry out conformity certification and testing for building material products and goods included in the Designation Decision and also included in the list of building material products and goods according to the Technical Regulation QCVN 16:2023/BXD until the expiration of the Designation Decision.

3. In case the designation decision expires during the period when this Regulation is promulgated but has not yet taken effect, it is allowed to extend the conformity certification and testing activities until the effective date of this Regulation.
