04/2022/TT-BXD REGULATING TASK DOSSIERS AND CONSTRUCTION PLANNING SCHEME DOSSIERS FOR INTER-DISTRICT, DISTRICT REGIONS, URBAN AREAS, FUNCTIONAL ZONES AND RURAL AREAS
Pursuant to Clause 3, Article 18 of the Law on Urban Planning 2009 which was amended and supplemented in the Law on amendment and supplementation of a number of articles of 37 laws related to planning in 2019;
Pursuant to Clause 5, Article 27 of the Government’s Decree No. 44/2015/ND-CP dated May 6, 2015 detailing some contents on construction planning; which was amended and supplemented in Decree No. 72/2019/ND-CP dated August 30, 2019 amending and supplementing a number of articles of Decree No. 37/2010/ND-CP dated April 7, 2010 on the formulation, appraisal, approval and management of urban planning and Decree No. 44/2015/ND-CP dated May 6, 2015 detailing a number of contents on construction planning (hereinafter referred to as Decree No. 37/2010/ND-CP and Decree No. 44/2015/ND-CP);
Pursuant to Decree No. 52/2022/ND-CP dated August 8, 2022 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Construction;

The Minister of Construction promulgates the Circular regulating task dossiers and construction planning scheme dossiers for inter-district regions, district regions, urban areas, functional zones and rural areas.
Chapter I GENERAL PROVISIONS
Article 1. Scope of regulation and subjects of application
1. This Circular regulates the contents of task dossiers and dossiers of construction planning schemes for inter-district regions, district regions, urban areas, functional zones and rural areas (hereinafter referred to as urban and rural planning).
2. Domestic and foreign organizations and individuals when directly participating in or related to urban and rural planning work in the territory of Vietnam must comply with the provisions of this Circular.
Article 2. General provisions on presentation formats
1. The contents presented in the explanations and drawings of tasks and schemes in dossiers for soliciting opinions, appraisal and approval dossiers must be clearly and fully presented for each type and level of planning and comply with the provisions in Chapter II and the appendices of this Circular.
2. The system of drawing symbols of urban and rural planning tasks and schemes must comply with the provisions in the appendices enclosed with this Circular.
3. Based on the conditions and characteristics of the inter-district regions, district regions, urban areas, functional zones and rural areas to be planned, separate maps and diagrams can be created for each current status content and technical infrastructure orientation to ensure full presentation of contents as required.
4. In case the regional planning and provincial planning have not been approved, the maps of urban and rural system development orientation; maps of urban and rural system planning options; maps of land use planning at the provincial level; maps of spatial organization and functional zoning in regional and provincial planning are replaced by the spatial development orientation diagrams in the approved provincial-level construction planning.
5. All diagrams and maps in the drawing component of the task dossiers and the dossiers of urban and rural planning schemes must clearly present the planning boundary; boundaries and names of administrative units within the planning scope; names of adjacent administrative units outside the planning scope.
Chapter II CONTENTS OF TASK DOSSIERS AND DOSSIERS OF URBAN AND RURAL PLANNING SCHEMES
Section 1. TASK DOSSIERS AND DOSSIERS OF CONSTRUCTION PLANNING SCHEMES FOR INTER-DISTRICT AND DISTRICT REGIONS (HEREINAFTER REFERRED TO AS DISTRICT-LEVEL PLANNING)
Article 3. Contents of task dossiers of district-level planning
1. Drawings include: Diagram of location and regional relationships; map of boundaries and scope of district-level planning. Presented on the base map of urban and rural system planning options in provincial planning at an appropriate scale.
2. The explanation of district-level planning tasks includes:
a) Reasons, necessity for planning formulation; bases for formulating planning tasks. For inter-district construction planning, it is necessary to justify the basis for determining the scale, scope and boundary of the planned region.
b) Overview of the natural conditions and current status of the planned region; development orientations and planning options in relevant plannings that have impacts on the planned region. Briefly state the existing problems that need to be solved in district-level planning.
c) Determine the viewpoint, objectives of planning; nature and functions of the region.
d) Bases and methods to determine regional development drivers; preliminary forecasts on: population, land, urbanization rate, economic development, etc.; propose the selection of technical and social infrastructure criteria according to each development stage.
e) Requirements on the level of investigation and survey, collection of documents and data, assessment of the current status of inter-district and district regions to be planned; requirements on the current status database.
f) Requirements on the main contents of district-level planning.
g) Determine the list of enclosed drawings, explanations, appendices; quantity and specifications of planning scheme dossier products; cost estimates; planning schedule and progress; determine requirements on contents, forms and subjects for soliciting opinions on planning schemes.
3. Draft Submission Letter and draft Decision on approving the planning task.
Article 4. Contents of dossiers of district-level planning schemes
1. The drawing component includes:
a) Diagram of location and regional relationships: Location and boundary of the planned region; natural, socio-economic and environmental relationships in provincial planning that affect the planned region. Presented on the base map of urban and rural system planning options in provincial planning at an appropriate scale.
b) Map of the current regional status: Natural conditions, current distribution of population and land use in the planned region; current status of national, regional, provincial and district-level social and technical infrastructure systems in the area according to the provisions of Appendix II of this Circular. Drawings are presented on topographic base maps at a scale of 1/10,000 or 1/25,000.
c) Map of development management zoning: Determine zones for management; drawings are presented on topographic base maps at a scale of 1/10,000 or 1/25,000.
d) Map of regional spatial development orientation: Determine the development space of urban areas, rural residential areas; national, provincial and district-level functional zones according to regional planning, provincial planning and technical specialized planning; areas for national defense and security; areas for developing centers: administration, commerce – services, culture, sports, research, training, healthcare from district level and above; locations of commune cluster centers, commune centers; areas for agricultural and forestry development, historical – cultural relics, scenic landscapes and other economic – technical facilities according to planning stages (as prescribed in Appendix II of this Circular). Drawings are presented on topographic base maps at a scale of 1/10,000 or 1/25,000.
e) Map of regional technical infrastructure development orientation: Determine the network, location and scale of national, regional, provincial and district-level technical infrastructure works for each sector including site preparation, transportation (to inter-commune roads), power system, water supply, energy supply, drainage and wastewater treatment, solid waste management, cemeteries and passive telecommunications infrastructure. Drawings are presented on the base map of regional spatial development orientation combined with topographic maps at a scale of 1/10,000 or 1/25,000.
2. The explanation includes the following contents:
a) Reasons and necessity for formulating district-level planning; bases for planning formulation; location, scale and scope of planning; viewpoints and development objectives of the region.
b) Analyze and assess the natural conditions and socio-economic status of the region; current distribution of urban areas and rural residential areas, population changes in the planned region; current status of land use and management; current status of national, regional, provincial and district-level social and technical infrastructure; current status of resources and environment; current status of investment and development programs and projects for the planned region; assess the management of planning implementation, resource management and environmental protection.
For inter-district construction planning, the explanation additionally includes the following contents: Assess the coordination and development linkage between districts in the region; point out the effectiveness and shortcomings in implementing the development linkage for planning implementation management as a basis for proposing solutions in the planning scheme.
c) Determine the drivers and development potentials of the region; impacts of national, regional and provincial-level social and technical infrastructure systems on the planned region.
d) Forecast economic development, population, labor, urbanization rate, land use demand, environmental protection; risks of fluctuations, natural disasters, etc.
e) Organize zoning and requirements for management and development according to zones.
f) Spatial development orientation: Location, scale and orientation of organizing urban development areas, rural residential areas; national, provincial and district-level functional zones according to regional planning, provincial planning and sectoral planning; national defense and security areas; areas for agricultural and forestry development, historical – cultural relics, scenic landscapes and other economic – technical facilities. Organize the distribution of center systems: administration, commerce – services, culture, sports, research, training, healthcare from district level and above; commune cluster centers, commune centers. Determine general urban planning; construction general planning, construction zoning planning of functional zones; general construction planning of communes to be formulated according to development stages.
g) Technical infrastructure development orientation of the region regarding site preparation, transportation, power system, water supply, energy supply, drainage and wastewater treatment, waste management, cemeteries and passive telecommunications infrastructure.
h) Determine the list of priority investment programs and projects on technical infrastructure, social infrastructure and environmental protection; projects need to clearly state the scale of construction investment, forecast capital needs and propose capital sources and implementation time.
i) Propose solutions to implement the planning after being approved by competent authorities. For regions that cover many district-level administrative units, it is necessary to propose models, management mechanisms and development linkage of inter-district regions.
k) Propose environmental protection solutions in the region.
3. Regulations on management according to district-level planning: Contents are prescribed in Article 9 of Decree No. 44/2015/ND-CP and must include enclosed diagrams.
4. Draft Submission Letter and draft Decision on approving the planning scheme.
5. Appendices enclosed with the explanation (additional justifications, explanations, arguments for the explanation; illustrative drawings; calculation data); enclosed legal documents.
Section 2. TASK DOSSIERS AND DOSSIERS OF URBAN PLANNING SCHEMES
Article 5. Contents of task dossiers of general urban planning
The tasks of general planning for urban areas that are centrally-run cities, cities under centrally-run cities, provincial cities, towns, townships and new urban areas (including class-IV urban areas and above that have not been recognized as cities or towns; new urban areas expected to be provincial towns or cities; class-V urban areas that have not been recognized as townships and new class-V urban areas) shall comply with the provisions of this Article.
1. Drawings in the task dossiers of general urban planning
a) Drawings in the task dossiers of general planning for centrally-run cities include: Diagram of location and regional relationships in the national urban and rural system planning, regional planning; map of boundaries and scope of general city planning. Drawings are presented at an appropriate scale on the base map of national urban and rural system development orientation; map of urban and rural system development orientation.
b) Drawings in the task dossiers of general planning for provincial cities, towns, townships and new urban areas include: Diagram of location and relationships in the national urban and rural system planning, regional planning (for class-III urban areas and above) and provincial planning; map of boundaries and scope of general urban planning. Drawings are presented at an appropriate scale on the base map of national urban system development orientation, map of urban and rural system development orientation (for class-III urban areas and above) and map of urban and rural system planning options.
2. The explanation includes the following contents:
a) Reasons, necessity, bases for planning formulation; location, scale, scope and boundary of general urban planning. For new urban areas, it is necessary to fully justify the scope and boundary of planning.
b) Overview of natural conditions and current status of the urban area; briefly summarize the main existing problems in the process of urban management and development implementation. State the development orientations in national planning, regional planning and urban development plans according to urban development programs; planning options in provincial planning and projects being implemented that have impacts on the scope of general urban planning.
c) Determine the nature, development drivers, role of the urban area for the country, region and province; viewpoints and objectives of planning; preliminarily identify the main issues to be solved in planning.
d) Preliminarily forecast the socio-economic development, population, labor, occupations, urban development land, rural residential areas and technical infrastructure.
e) Requirements on the level of investigation and survey, collection of documents and data, assessment of the current urban status; requirements on the current status database.
f) Requirements on the main contents of general urban planning.
g) Determine the list of enclosed drawings, explanations, appendices; quantity and specifications of planning scheme dossier products; cost estimates; planning schedule and progress; determine requirements on contents, forms and subjects for soliciting opinions on planning schemes.
3. Draft Submission Letter and draft Decision on approving the planning task.
Article 6. Contents of dossiers of general planning schemes for centrally-run cities
1. Drawing component:
a) Diagram of location and regional relationships including: Location, scale, planning boundary; natural, socio-economic, urban spatial development, technical infrastructure and environmental relationships in national planning, regional planning that affect the planned city. Drawings are presented at an appropriate scale on the base map of national urban and rural system development orientation; map of urban and rural system development orientation.
b) Diagram of current spatial development and technical infrastructure of the entire city: Location and scale of functional zones, social and technical infrastructure systems, areas for protecting national and regional heritage, relics, landscapes in the city; location and scale of functional areas, urban areas and skeleton technical infrastructure system of the city; scope and boundary of the central urban area; location of commune cluster centers, commune centers and concentrated rural residential areas. Drawings are presented on topographic base maps at a scale of 1/25,000 or 1/50,000.
c) Map of the current status of the central urban area: Current status of land use functions as prescribed in Appendix III of this Circular; architectural landscape, social infrastructure system (education, healthcare, culture, commerce, greenery, housing, etc.); technical infrastructure system (transportation, power supply and urban lighting, telecommunications, water supply, ground elevation and stormwater drainage, wastewater drainage; solid waste management, cemeteries and environment). Drawings are presented on topographic base maps at a scale of 1/10,000 or 1/25,000.
d) Map of comprehensive assessment of construction land based on determining appropriate evaluation criteria on topography, current conditions, hydrogeology; land use (identifying areas that are favorable, less favorable, unfavorable for developing urban functions, etc.); identifying prohibited areas, areas with restricted urban development. Drawings are presented on topographic base maps at a scale of 1/10,000 or 1/25,000 or 1/50,000.
e) Diagram of urban development structure (including diagrams analyzing the current status and proposing options accompanied by explanations of the criteria for considering and selecting options), identifying the framework of the main transportation system, the linkages between main functional areas, central areas and the direction of urban expansion. Drawings are presented on topographic base maps at an appropriate scale.
f) Diagram of spatial development orientation of the entire urban area: Identifying the location and scale of urban areas in the city; scope of the central urban area; scale and scope of national, regional, provincial and city-level functional zones, areas for agricultural and forestry development, historical – cultural relics, scenic landscapes, ecology, conservation, national defense and security, etc.; location of commune centers, commune cluster centers (if any), concentrated rural residential areas. Identifying urban spatial axes and development corridors of the city. Drawings are presented on topographic base maps at a scale of 1/25,000 or 1/50,000.
g) Diagram of technical infrastructure development orientation of the entire urban area: Identifying the network, location and scale of national, regional and urban technical infrastructure works in the city and the contents prescribed in Point a, Clause 6, Article 15 of Decree No. 37/2010/ND-CP for each sector including: Site preparation, transportation (to inter-regional roads), power system, water supply, energy supply, drainage and wastewater treatment, solid waste management, cemeteries, passive telecommunications infrastructure and other technical infrastructure works. Drawings are presented on the base diagram of spatial development orientation of the entire urban area combined with topographic maps at a scale of 1/25,000 or 1/50,000.
h) Diagram of spatial development orientation of the central urban area: Identifying the scope and scale of functional zones; function-converted areas; areas with restricted development, areas for renovation and upgrading, areas to be conserved and embellished; new development areas (in which the scope and scale of residential areas are identified; national, regional and city-level functional zones); areas to be conserved and embellished; no-construction zones; reserve development areas; defense and security areas. Identifying the location and scale of center systems: Administration, commerce – services, culture, sports, urban parks, greenery and open spaces; specialized centers for research, training, healthcare, etc. at national, regional and city levels. Identifying areas planned for underground construction works. Drawings are presented on topographic base maps at a scale of 1/10,000 or 1/25,000.
i) Map of land use planning of the central urban area: Location and scale of land use types as prescribed in Appendix III of this Circular; identifying the population scale, criteria on population density, land use of each urban functional area according to development stages. Drawings are presented on topographic base maps at a scale of 1/10,000.
l) Maps of technical infrastructure development orientation and environmental protection of the central urban area: Contents are prescribed at Point b, Clause 6, Article 15 of Decree No. 37/2010/ND-CP. Drawings are presented on the base map of land use planning of the central urban area combined with topographic maps at a scale of 1/10,000 or 1/25,000.
m) Urban design drawings: Implemented according to the provisions of Circular No. 06/2013/TT-BXD dated May 13, 2013 of the Minister of Construction guiding the contents of urban design and Circular No. 16/2013/TT-BXD dated October 16, 2013 of the Minister of Construction amending and supplementing a number of articles of Circular No. 06/2013/TT-BXD dated May 13, 2016 of the Minister of Construction guiding the contents of urban design (hereinafter referred to as Circular No. 06/2013/TT-BXD).
2. The explanation includes the following contents:
The contents of the explanation of the dossier of the general planning scheme for centrally-run cities include:
a) Analyzing the location, assessing natural conditions; current status of population, land use, architectural landscape, social infrastructure, technical infrastructure and environment. Assessing the management and implementation of the approved planning on spatial development, land use and technical infrastructure. Assessing the current status of investment and development programs and projects being implemented in the city. Identifying the basic issues to be solved. Data must be summarized and presented with diagrams and tables accompanied by concise and clear explanations.
b) Determining the objectives, nature and development drivers of the city.
c) Determining the technical-economic criteria for the whole city, each urban area and the central urban area.
d) Assessing and forecasting the impacts of natural and socio-economic conditions; analyzing the orientations and requirements of approved national planning, regional planning and technical specialized planning on the city’s development orientation. Forecasting development indicators: Urbanization rate, population scale, land, social infrastructure, technical infrastructure for the whole city; each urban area, the central urban area and urban functional zones in the city.
e) Determining the principles and criteria for selecting urban development structure options.
f) Spatial development orientation: Contents are prescribed at Point a, Clause 5, Article 15 of Decree No. 37/2010/ND-CP. Determining the scope and limit of spatial development of the central urban area and cities, towns and townships under the centrally-run city; proposing inner city and suburb areas; identifying areas that need to formulate urban zoning planning; construction zoning planning of functional zones; general construction planning of communes according to planning stages.
g) Spatial development orientation for the central urban area: Contents are prescribed at Point b, Clause 5, Article 15 of Decree No. 37/2010/ND-CP. The center system is identified according to national, regional and city levels.
h) Land use planning orientation for the entire urban area and the central urban area according to planning stages. In the central urban area, determining the scale for land use functions as prescribed in Appendix III of this Circular.
i) Urban design according to the provisions of Circular No. 06/2013/TT-BXD.
k) Urban technical infrastructure development orientation including: Technical infrastructure development orientation of the entire city and technical infrastructure development orientation for the central urban area as a basis for implementing technical infrastructure specialized planning schemes for centrally-run cities.
l) Proposing environmental protection solutions in the region.
m) Proposing lists of priority planning, programs and projects: Justifying and identifying lists of priority investment planning, programs and projects according to stages; proposing and recommending resources for implementation.
3. Appendices and drawings enclosed with the explanation include: Additional justifications, explanations and arguments for the explanation; tables and calculation data showing the results stated in the explanation; A3-sized drawings; related legal documents.
4. Regulations on management according to the general urban planning scheme: Contents are prescribed in Clause 1, Article 35 of the Urban Planning Law and must have enclosed A3-sized drawings.
5. Draft Submission Letter and draft Decision on approving the planning scheme.
Article 7. Contents of dossiers of general planning schemes for provincial cities, towns, class-IV urban areas and above that have not been recognized as cities or towns; new urban areas expected to be provincial cities and towns
1. Drawing component:
a) Diagram of location and regional relationships including: Location, scale, planning boundary; natural, socio-economic, urban spatial development, technical infrastructure and environmental relationships in national planning, regional planning (for class-III urban areas and above), provincial planning (centrally-run cities for urban areas under centrally-run cities) that affect the planned urban area. Drawings are presented at an appropriate scale on the base map of national urban system development orientation, map of urban and rural system development orientation (for class-III urban areas and above) and map of urban and rural system planning options (or spatial development orientation of the entire urban area for urban areas under centrally-run cities).
b) Map of current status: Current status of land use functions as prescribed in Appendix III of this Circular; architectural landscape, social infrastructure system (education, healthcare, culture, commerce, greenery, housing, etc.); technical infrastructure system (transportation, power supply and urban lighting, telecommunications, water supply, ground elevation and stormwater drainage, wastewater drainage; solid waste management, cemeteries and environment). Drawings are presented on topographic base maps at a scale of 1/10,000.
c) Map of comprehensive assessment of construction land based on appropriate evaluation criteria on topography, current conditions, hydrogeology; assessment of legal status and land use: Identifying areas that are favorable, less favorable, unfavorable for developing urban functions; identifying prohibited areas and areas with restricted urban development. Drawings are presented on topographic base maps at a scale of 1/10,000.
d) Diagram of urban development structure (diagrams analyzing the current status and proposing options accompanied by explanations of the criteria for considering and selecting options). Drawings are presented on topographic base maps at an appropriate scale.
e) Map of urban spatial development orientation: Identifying areas with restricted development; areas for renovation and upgrading; new development areas (in which the scope and scale of residential areas are identified; national, regional, provincial and urban functional zones); areas to be conserved and embellished; no-construction zones; reserve development areas; defense and security areas; center areas: administration, commerce – services, culture, sports, parks, greenery, research, training, healthcare and other specialized centers from urban level and above; areas planned for underground construction works (for class-III urban areas and above). Identifying the main spatial axes and open spaces of the urban area. Identifying rural residential areas. Drawings are presented on topographic base maps at a scale of 1/10,000.
f) Map of urban land use planning according to planning stages: Location and scale of land use types as prescribed in Appendix III of this Circular. Identifying the population scale and land of each urban functional area; criteria on population density and urban planning land according to development stages. Drawings are presented on topographic base maps at a scale of 1/10,000.
g) Maps of technical infrastructure development orientation: Identifying the network, location and scale of national, regional, provincial and urban technical infrastructure works in the area and the contents prescribed in Clause 5, Article 16 of Decree No. 37/2010/ND-CP for each sector including: Site preparation, transportation, power system, water supply, energy supply, drainage and wastewater treatment, solid waste management, cemeteries, passive telecommunications infrastructure and other technical infrastructure works. Drawings are presented on the base map of urban land use planning according to planning stages combined with topographic maps at a scale of 1/10,000.
h) Urban design drawings: Implemented according to the provisions of Circular No. 06/2013/TT-BXD.
2. The explanation includes the following contents:
a) Analyzing the location, assessing natural conditions; current status of population, land use, architectural landscape, social infrastructure, technical infrastructure and environment. Assessing the management and implementation of the approved planning on spatial development, land use and technical infrastructure; comparing and contrasting with the orientation and criteria in the approved planning (if any); assessing the current urban status according to urban classification standards and criteria. Assessing the current status of investment and development programs and projects being implemented in the area. Identifying the basic issues to be solved.
b) Determining the objectives, nature and development drivers of the urban area.
c) Determining the technical-economic criteria for the urban area and each urban functional area.
d) Assessing and forecasting the impacts of natural and socio-economic conditions; approved national planning, regional planning, provincial planning and technical specialized planning on the urban area’s development orientation. Forecasting development indicators: urbanization rate, population scale, land, social infrastructure, technical infrastructure for the urban area and urban functional zones.
e) Determining the principles and criteria for selecting urban development structure options.
f) Urban spatial development orientation: Contents are prescribed in Clause 4, Article 16 of Decree No. 37/2010/ND-CP. Proposing inner city and suburb areas; identifying areas that need to formulate zoning planning and general construction planning of communes according to planning stages.
g) Urban land use planning orientation according to planning stages. Determining the scale for land use functions as prescribed in Appendix III of this Circular.
h) Urban design: Implemented according to the provisions of Circular No. 06/2013/TT-BXD.
i) Urban technical infrastructure development orientation including: Transportation, ground elevation and stormwater drainage, energy supply, telecommunications, water supply, wastewater drainage, solid waste management and cemeteries according to the contents prescribed in Clause 5, Article 16 of Decree No. 37/2010/ND-CP.
k) Proposing environmental protection solutions.
l) Proposing lists of priority planning, programs and projects: Justifying and identifying lists of priority investment planning, programs and projects according to planning stages; proposing and recommending resources for implementation.
The explanation of the general planning scheme for provincial cities and towns must have statistical tables, calculation appendices, illustrative images and a system of diagrams and A3-sized drawings with symbols and notes, arranged and enclosed with the contents for each relevant part of the explanation.
c) Appendices and drawings enclosed with the explanation include: Additional justifications, explanations and arguments for the explanation; tables and calculation data showing the results stated in the explanation; A3-sized drawings; related legal documents.
d) Regulations on management according to the general urban planning scheme: Contents are prescribed in Clause 1, Article 35 of the Urban Planning Law and must have enclosed A3-sized drawings.
e) Draft Submission Letter and draft Decision on approving the planning scheme.
Article 8. Contents of the general planning dossier for towns, class V urban areas not yet recognized as townships, and new class V urban areas.
1. Drawing components:
a) Diagram of location and regional relations including: Location, scale, planning boundary; natural, socio-economic, urban development spatial, technical infrastructure and environmental relationships within the provincial planning (general planning of centrally-run cities), district planning that affect the planned urban area. The drawing is presented at an appropriate scale on the base map of the urban and rural system planning scheme (or the Spatial Development Orientation Diagram of the entire centrally-run city for urban areas under centrally-run cities) and the inter-district and district spatial development orientation diagram (if any).

Evaluating the management and implementation of the approved planning on spatial development, land use, technical infrastructure; comparing and contrasting with the orientations and targets in the approved planning (if any); assessing the current urban status according to urban classification standards and criteria. 2. The explanatory statement includes the following contents:
a) Reasons, necessity, and basis for zoning planning; determining the location and rationale for the scope and boundary of zoning planning; determining the area scale, management requirements, and development investment for the zoning planning area.
b) Summarizing the natural characteristics and current status of the zoning planning area. Stating the development orientations in the approved urban general planning and the specialized technical plannings being implemented that impact the scope of zoning planning. Preliminarily identifying the main issues to be addressed and requirements for specifying the approved urban general planning.
c) Preliminarily determining the population scale, land, and needs for technical infrastructure and social infrastructure for the planning area.
d) Requirements for surveying the current status, collecting documents and data, assessing the current urban status; requirements for the current status database.
đ) Requirements on the main contents of the zoning planning.

b) Current land use and architectural landscape map: Current functional land use as prescribed in Appendix V of this Circular and land use indicators; current status of architectural landscape, social infrastructure system (education, health, culture, sports, commerce, greenery, housing, etc.), protected areas of relics, heritage, scenic spots. The drawing is presented on a 1/2,000 or 1/5,000 scale topographic base map.
c) Current status maps of technical infrastructure systems and environmental protection: Transportation, electricity supply and urban lighting, telecommunications, water supply, ground elevation and rainwater drainage, wastewater drainage; solid waste management, cemeteries and environment; other technical infrastructure works. The maps are presented on a 1/2,000 or 1/5,000 scale topographic base map.
d) Master plan of land use: Determining the area scale, population and planned land use norms for each block in the planning area as prescribed in Appendix V of this Circular; building setbacks for road axes in the planning area; location and scale of underground works. Identifying residential units; location and scale of social infrastructure of urban level and above (if any) and at residential unit level in the area. The drawing is presented on a 1/2,000 or 1/5,000 scale topographic base map.
đ) Architectural and landscape spatial organization diagram: The drawing is presented on a 1/2,000 or 1/5,000 scale topographic base map.

b) Defining the objectives of planning. Stating the main requirements and orientations in the approved urban general planning along with the promulgated management regulations for the zoning planning area.
c) Selecting land, social infrastructure and technical infrastructure norms applicable to the entire planning area; determining the population scale, land, needs for technical infrastructure and social infrastructure for the planning area.
d) Stating the principles and requirements on spatial organization, architecture, landscape; regulations on land use for each functional zone, main road, open space, landmark, central area, conservation area (if any). Map of boundaries, research scope and scale of the area for detailed urban planning; presented at an appropriate scale on the base map of the general land use planning of the urban zoning planning.
2. The explanation includes the following contents:
a) Reasons, necessity, bases for formulating detailed urban planning; location, boundary, area, function of the planning area. Preliminary development orientations in the approved general urban planning and zoning planning that affect the planning scope. State the management and investment development needs for the planning area. The detailed planning must be consistent with and concretize the approved zoning planning.
b) Briefly assess the natural characteristics and current status, preliminarily identify the basic issues and contents to be solved in the detailed urban planning scheme and requirements for concretizing the approved zoning planning.
c) Forecast the population scale; basic criteria applied in the scheme on land use needs, social infrastructure and technical infrastructure based on the regulations of the approved zoning planning and general urban planning.
d) Specific requirements on investigation and survey, collection of documents and data, assessment of the current status; requirements on the current status database.
e) Requirements on the main contents of detailed urban planning. Propose construction works that need investment in the planning area; determine requirements for studying spatial organization, architecture, landscape, land use, technical infrastructure connection and other requirements.

b) Map of current land use; architecture, landscape and assessment of construction land: Current status of land use functions as prescribed in Appendix VI of this Circular; architectural landscape, social infrastructure system (education, healthcare, culture, commerce, greenery, housing, etc.); assessment of construction land based on criteria on topography, current conditions, hydrogeology, land use. Drawings are presented on topographic base maps at a scale of 1/500.
c) Maps of the current status of technical infrastructure and environmental protection systems: Transportation, energy supply and urban lighting, telecommunications, water supply, ground elevation and stormwater drainage, wastewater drainage; solid waste management, cemeteries and environment. Drawings are presented on topographic base maps at a scale of 1/500.
d) Map of general land use planning: Determining the area scale, population and criteria for planning land use for each land lot (formed by internal roads) in the planning area as prescribed in Appendix VI of this Circular; building setbacks for axes of internal roads; location and scale of underground works. d) Determining land use functions, area scale, population, land use criteria for each land lot in the planning area; construction boundaries for each land lot and on axes of internal roads. Identifying areas for building social housing (if any).
e) Determining requirements for spatial organization and architectural landscape for the entire planning area and requirements for arranging works on each land lot (determining the height, floor and ceiling elevation of the first floor; main architectural form, fence, color, materials of works and other architectural objects for each land lot); organizing public greenery, gardens, street trees and water surfaces in the planning area. Identifying the location and scale of typical works and areas that need control, the contents to be implemented for control and the regulations to be implemented.

2. The explanatory statement includes the following contents:
a) Reasons, necessity for planning, scope, scale and boundary for general construction planning.
b) Overview of natural conditions, current status and major existing issues in the implementation of management and investment development in the area of general construction planning. State the development orientations in the national planning, regional planning; planning scheme in the approved provincial planning and projects being implemented that affect the scope of general construction planning of the functional zone.
c) Determine the nature, perspectives and objectives of planning; the role of the functional zone for the nation, region, and province; initially identify the main issues to be addressed in the planning.
d) Propose the selection of basic applied technical and economic norms, preliminary forecasts of population, land and technical infrastructure within the planning scope.
e) Requirements for the level of investigation and survey, collection of documents and data, assessment of current status; requirements for current status database.
f) Requirements on the main contents of the general planning of the functional zone.

Article 25. Contents of the general construction planning project dossier for functional zones
1. Drawing components:
a) Diagram of location and regional relationships: Location, scale, planning boundary; natural, socio-economic, urban and rural development, spatial organization and functional zoning, infrastructure development, resource use and environmental protection relationships in regional planning, provincial planning that affect the planned functional zone. The drawing is presented at an appropriate scale; on the base map of spatial organization and functional zoning in the approved regional planning and provincial planning.
b) Current status maps including: Current status of land use functions as specified in Appendix VII of this Circular; architectural landscape, social infrastructure system (education, healthcare, culture, commerce, greenery, housing, etc.); technical infrastructure system (transportation, energy supply and lighting, telecommunications, water supply, ground elevation and rainwater drainage, wastewater drainage; solid waste management, cemeteries and environment). The drawings are presented on the 1/5,000 or 1/10,000 scale topographic map.
c) Comprehensive assessment map and selection of construction land based on suitable assessment criteria on topography, current conditions, hydro-geological conditions; assessment of land use. Identify favorable, less favorable, and unfavorable areas for development; identify prohibited areas and areas with restricted development within the functional zone. The drawing is presented on the 1/5,000 or 1/10,000 scale topographic map.
d) Diagram of the development structure of the planning area (analytical diagrams of current status and proposed options accompanied by explanatory statements on the criteria for consideration and selection of options); showing the framework of the main transportation system, the linkage between the main functional areas, central areas and the development expansion direction of the functional zone. The drawing is presented on the 1/5,000 or 1/10,000 scale topographic map.
e) Spatial development orientation map: Determine the spatial development structure according to functional areas; key areas, architectural and landscape areas, main spatial axes, system of squares, gateway areas, focal points of the functional zone; transportation and technical infrastructure connections between areas; areas planned for underground works (if any).
For the general construction planning of economic zones and high-tech zones, it is necessary to identify and present the boundary of the areas that require development control interventions such as: Conservation and renovation areas, new development areas, other architectural and landscape areas needing protection, etc. The drawing is presented on the 1/10,000 scale topographic map.
f) Land use planning map according to planning stages: Location and scale of land use functions as specified in Appendix VII of this Circular; determine the population scale (if any), land, land use norms of each area in the functional zone according to the development stages. For the main spatial areas of economic zones, high-tech zones, research and training zones, it is necessary to specify the maximum and minimum building heights. The drawing is presented on the 1/10,000 scale topographic map.
g) Drawings on architectural and landscape control orientation: Identify architectural and landscape zones in the planning area; propose spatial organization of important axes, functional areas (central areas, gateway areas, main spatial axes, squares, green spaces, water surfaces and focal areas, landmark works, etc.). The drawing is presented on the topographic map at an appropriate scale.
h) Technical infrastructure development orientation maps: Identify the network, location and scale of national, regional, provincial and urban technical infrastructure works within the scope of general planning of the functional zone according to each sector including site preparation, transportation (up to main roads of the area), water supply, energy supply, drainage and wastewater treatment, solid waste management, cemeteries, passive telecommunications infrastructure and other technical infrastructure works. The drawing is presented on the land use planning map of the functional zone according to planning stages in combination with the 1/10,000 scale topographic map.
2. The explanatory statement includes the following contents:
a) Analysis of location, assessment of natural conditions; current status of population, land use functions, architectural landscape, social infrastructure, technical infrastructure and environment. Evaluate the management and implementation of the approved planning on spatial development, land use, technical infrastructure; compare and contrast with the orientation and norms in the approved planning (if any). Assess the current status of investment and development programs and projects being implemented in the area. Identify the basic issues to be addressed.
b) Determine the objectives and development drivers of the functional zone; determine the technical and economic norms for each area in the functional zone. Assess and forecast the impacts of natural and socio-economic conditions; approved national planning, regional planning, provincial planning and specialized technical planning on the development orientation of the functional zone. Forecast development indicators on population scale, labor, land, social infrastructure, technical infrastructure for the entire zone, urban and rural development areas (if any) and each functional area.
c) Propose and select the spatial development structure of the functional zone; determine the orientations and principles of development for urban and rural residential areas, other areas in the functional zone (industrial, tourist, service, ecological, conservation, etc.) and the organization of the center system.
d) Regulations on architectural and landscape control in the functional zone: Orientation for the development of spatial axes and development corridors as a basis for determining indicators on population density and land use functions. Orientations and development principles for each functional area of the planning zone, system of squares, gateway areas, landmark works, key areas, areas planned for underground works (if any) in the functional zone.
e) Orientation for the development of the technical infrastructure system of the functional zone including transportation (up to main roads of the area), site preparation, energy supply, telecommunications, water supply, waste management and cemeteries as prescribed in point e, clause 1, Article 12 of Decree No. 44/2015/ND-CP.

In case the functional zone is not within an area that has an approved general urban planning, general construction planning for economic zones, the drawings shall include: Diagram showing the location of the planning area, displayed on the background map of the spatial organization and functional zoning scheme in the provincial planning and the spatial development orientation diagram in the district planning (if any) at an appropriate scale; Map of the research boundary and scope of the zoning planning area, displayed at an appropriate scale on the background map of the land use planning scheme of the province.
In case the functional zone is within an urban area or an area belonging to a functional zone that already has an approved general planning, the drawings shall include: Diagram showing the location of the planning area; drawings displayed at an appropriate scale on the background map of the urban space development orientation or the functional zone of the approved general planning. Diagram of the research boundary and scope of the zoning planning area; displayed at an appropriate scale on the background map of the urban land use planning or the land use planning map of the functional zone according to the planning stages of the approved general planning.
2. The explanatory statement includes the following contents:
a) Reasons, basis, and necessity for formulating the zoning construction planning. Justification for the boundary, area, and characteristics of the planning area.
b) Overview of the natural conditions and current status of the zoning planning area. Stating the development orientations in the provincial planning (for functional zones formed outside urban areas), general urban planning or general construction planning for functional zones, and other approved or ongoing specialized technical planning that impact the scope of the zoning planning. Preliminary identification of the main issues to be addressed and requirements for specifying the approved provincial and general planning.
c) Preliminary determination of the population and land scale, infrastructure and social infrastructure needs for the planning area; proposing and selecting basic indicators to be applied based on analysis and synthesis from relevant approved planning.
d) Requirements for the level of site investigation and survey, data and document collection, current status assessment in the area; requirements for the current status database.
đ) Requirements for the main contents of the zoning planning.

b) Map of the current land use status and architecture and landscape: Current land use functions as specified in Appendix V of this Circular; architecture, landscape, social infrastructure system (education, healthcare, culture, commerce, greenery, housing, etc.), areas for protection of historical and cultural relics, heritage sites, scenic spots, and other functions in the area. The drawing is displayed on a topographic map background at a scale of 1/2,000.
c) Maps of the current status of technical infrastructure systems and environmental protection: Transportation, energy supply and urban lighting, telecommunications, water supply, ground elevation and stormwater drainage, wastewater drainage, solid waste management, cemeteries, and environment. d) Master land use planning map. c) Selecting land, social infrastructure, and technical infrastructure indicators to be applied for the entire planning area; population and land scale, technical infrastructure and social infrastructure needs for the planning area.
d) Specifying regulations on land use functions for each street block (formed by zoning-level roads) in the planning area. i) Drawings identifying areas for underground construction: Public underground works, high-rise buildings with basements (if any). Presented on the base map of spatial organization, architecture and landscape combined with the topographic map at an appropriate scale.
k) Drawings regulating architectural and landscape control in the planning area: Identify landmark buildings in the planning area according to directions and views; determine building heights, setbacks for each lot, on each street and intersection; determine main architectural form, color and materials of architectural works; system of greenery, water surface, squares. Presented on the base map of spatial organization, architecture and landscape at an appropriate scale.
2. The explanatory statement includes the following contents:
a) Determine the scope and scale of the planning area. Analyze the location, assess natural conditions; current status of population, land use, architectural landscape, social infrastructure, technical infrastructure and environment. Assess the current status of investment and development projects being implemented in the area. Identify the basic issues to be addressed.
b) Determine the planning objectives. Assess the alignment with the implementation plan specified in the general construction planning (if any), zoning construction planning; state the main requirements and orientations in the general planning and the main solutions in the approved zoning construction planning along with the issued management regulations related to the detailed planning area.
c) Select land, social infrastructure and technical infrastructure norms applied to the entire planning area; population scale, land, technical infrastructure and social infrastructure needs for the planning area.
d) Determine land use functions, scale of area, population, land use norms for each lot in the planning area; construction boundaries for each lot and on road axes. Identify areas for social housing construction (if any).
e) Determine requirements for spatial organization, architectural landscape for the entire planning area and requirements for the arrangement of works on each lot (specifying height, floor and ceiling level of the ground floor; main architectural form, fence, color and materials of works and other architectural objects for each lot); organization of public greenery, gardens, street trees and water surface in the planning area. Identify the location and scale of works and typical areas to be controlled, the contents to be implemented for control and the regulations to be followed.
f) Prescribe or propose specific building design solutions.
g) Identify areas for underground construction (public underground works, high-rise buildings with basements, etc.).
h) Planning of technical infrastructure system: Implemented according to the provisions of point e, clause 1, Article 14 of Decree No. 44/2015/ND-CP.
i) Propose environmental protection solutions.
j) Preliminary estimate of the total investment; propose solutions on capital sources and organization of implementation.
The explanatory statement of the detailed construction planning project must have statistical tables, calculation appendices, illustrative images and a system of A3-size diagrams and drawings with clear symbols and annotations, arranged in accordance with the content for each relevant explanatory part.
3. Appendices attached to the explanatory statement (additional justifications, explanations, arguments for the explanatory statement; illustrative drawings; calculation data and relevant legal documents).
4. Management regulations according to the detailed construction planning project: Contents as prescribed in clause 3, Article 15 of Decree No. 44/2015/ND-CP and must have accompanying diagrams.
5. Draft Submission Letter and draft Decision approving the project.
Article 30. Contents of the abridged detailed construction planning project dossier
1. Drawing components
a) Diagram of location, scope of land area boundary in the approved zoning plan; presented at an appropriate scale on the base map of the land use master plan of the approved zoning construction plan.
For non-linear technical infrastructure works mentioned in clause 4, Article 1 of the Decree amending and supplementing a number of articles of the Decrees under the state management of the Ministry of Construction, the diagram of location and scope of planning boundary is presented at an appropriate scale; on the base map of land use planning by planning stages of the general construction planning or the provincial land use planning map in the provincial planning dossier or the base map of the approved specialized technical planning scheme.
b) Drawing of the general layout and architectural scheme of the works: Determine the location and scale of works and items within the lot (including underground works); planned land use norms; organization of gardens, internal roads in the planning area; The drawing is presented on the 1/500 scale topographic map.
c) Drawing of the technical infrastructure system including the contents: Transportation, site preparation, energy supply and lighting, wastewater drainage, solid waste management, passive telecommunications infrastructure and other technical infrastructure works; presented on the 1/500 scale topographic map.
2. The explanatory statement includes the following contents:
a) Determine the scope and scale of the planning area. Analyze the location, assess natural conditions; population scale, current status of land use, architectural works, landscape, technical infrastructure and environment in the planning area.
b) Determine the planning objectives. State the main requirements and orientations in the general planning and the main solutions in the approved zoning construction planning along with the issued management regulations related to the abridged detailed planning area.
c) Select land, social infrastructure and technical infrastructure norms applied to the entire planning area; population scale, technical infrastructure and social infrastructure needs for the planning area.
d) Determine land use functions, scale of area, population, land use norms for each lot in the planning area; construction boundaries for each lot and on internal road axes.
e) Determine requirements for spatial organization, architectural landscape for the entire planning area and requirements for the arrangement of works and items within the land area (specifying height, floor and ceiling level of the ground floor; main architectural form, fence, color and materials of works and other architectural objects for each lot); organization of gardens and greenery in the planning area.
f) Identify areas for underground construction (public underground works, high-rise buildings with basements, etc.).
g) Planning of technical infrastructure system: Implemented according to the provisions of point e, clause 1, Article 14 of Decree No. 44/2015/ND-CP.
3. Draft Submission Letter and draft Decision approving the planning project.
4. Appendices attached to the explanatory statement (justifications, explanations, additional arguments for the explanatory statement; illustrative drawings; calculation data). Appendices with attached relevant legal documents.
Section 4. TASK DOSSIERS AND PLANNING PROJECT DOSSIERS FOR RURAL PLANNING
Article 31. Principles for rural planning
1. Comply with clause 6, Article 1 of Decree No. 72/2019/ND-CP dated August 30, 2019 of the Government amending and supplementing a number of articles of Decree No. 37/2010/ND-CP dated April 7, 2010 on the formulation, appraisal, approval and management of urban planning and Decree No. 44/2015/ND-CP dated May 6, 2015 detailing a number of contents on construction planning.
2. Ensure the implementation of relevant national criteria on new rural areas at the commune and district levels according to the Prime Minister’s Decision.
Districts belonging to the approved general urban planning for centrally-run cities and communes belonging to the approved general urban planning are considered to have met the planning criteria for consideration and evaluation of recognition as new rural districts and new rural communes.
Article 32. Collecting opinions on rural planning
1. Responsibilities, forms, and timelines for collecting opinions on rural planning shall comply with Article 16, Article 17 of the Construction Law 2014 and Article 23, Article 24 of Decree No. 44/2015/ND-CP.
2. Contents for collecting opinions on rural planning:
a) Contents for collecting opinions on the task assignment and master plan for commune construction include: Basic orientations for population development; key technical infrastructure works, social infrastructure, agricultural production, small-scale industry, and services.
b) Contents for collecting opinions on the task assignment and detailed planning for rural residential areas include: Spatial organization; scale of public works, services, housing, and technical infrastructure works.
Article 33. Contents of the task assignment dossier for master planning of commune construction
1. Drawings include: Location diagram, district and inter-district regional relationships, map of the research boundary for the commune construction master planning at an appropriate scale.
2. The explanatory statement includes the following contents:
a) Reasons, necessity, and basis for planning; determining the scale, scope, and boundary of the planning area.
b) Determining the objectives of the planning; characteristics, main functions, dominant economy of the commune (pure agriculture, combined agriculture and forestry, small-scale industry; agricultural production combined with tourism, etc.), meeting the criteria for new rural development, model new rural areas, advanced new rural areas.
c) Preliminary forecasts of population scale, labor force, total commune construction land scale within the planning period and planning stages.
d) Requirements during the planning process include: Analyzing and assessing the current status including: Current natural conditions, current land use, housing, public works, services, technical infrastructure, production, environment, etc. Identifying impact factors from the surrounding areas affecting the spatial development in the commune. Reviewing and assessing ongoing projects and planning in the commune. Identifying the main potential and driving forces for the commune’s socio-economic development. Organizing the overall spatial structure of the commune, organizing and distributing functional zones; technical infrastructure, production-supporting infrastructure. Proposing environmental protection solutions.
đ) List of drawings, number of dossier sets, and total cost estimate for planning.
e) Progress and organization of planning implementation; specifying requirements for content, format, and stakeholders for collecting opinions on the planning.
3. Draft Decision approving the task assignment for commune construction master planning.
Article 34. Contents of the commune construction master planning dossier
1. Drawing components:
a) Location diagram, regional relationships: Determining the location and planning boundary (entire administrative boundary of the commune); showing the relationships between the commune and relevant districts in the region in terms of socio-economy; topographical and geographical conditions, areas greatly affecting the architectural landscape of the commune; key technical infrastructure and other issues impacting the commune’s development. Displayed at an appropriate scale.
b) Map of integrated current status, assessment of construction land: Land use, architectural landscape, social infrastructure system (education, healthcare, culture, commerce, greenery, housing, etc.); current status of transportation, power supply and lighting, water supply, ground elevation and stormwater drainage, wastewater drainage; solid waste collection, cemeteries, environment. Identifying favorable, less favorable, and unfavorable areas for the commune’s development. Displayed at a scale of 1/5,000 or 1/10,000.
c) Diagram of spatial development orientation for the entire commune. Displayed at a scale of 1/5,000 or 1/10,000.
d) Land use planning map. Displayed at a scale of 1/5,000 or 1/10,000.
đ) Planning map of technical infrastructure and environment systems; production-supporting infrastructure. Displayed at a scale of 1/5,000 or 1/10,000.
2. The explanatory statement includes the following contents:
a) Stating the reasons and necessity for planning; fully stating the planning basis; defining the planning viewpoints and objectives.
b) Analyzing and assessing the integrated current status: Natural conditions such as geography, topography, geomorphology, climate, hydrology, soil, water resources, forests, seas. Impacts of natural disasters, climate change, environment, and ecosystems. Population (number of households, population structure, labor structure, development characteristics), cultural and ethnic characteristics, and population distribution. Economic development in agricultural and non-agricultural sectors; assessing strengths, potentials, and limitations in economic development. Current status of land use and changes in each type of land (noting issues in agricultural land use and exploitation; existing problems in land use). Current status of housing, public works, technical infrastructure, production-supporting infrastructure, environment, historical and cultural relics, scenic spots, and tourist attractions. Implementation of relevant planning, ongoing and completed projects in the commune.
c) Identifying potentials, driving forces, and forecasting the commune’s development: Forecasting the population scale, labor force, number of households for the 10-year planning period and 5-year planning stages. Forecasting the dominant types and driving forces of economic development such as: pure agriculture, combined agriculture and forestry; animal husbandry; small-scale industry; agricultural production combined with tourism services; production scale, key products, market potential, output solution orientation. Identifying the land potential for converting the land use structure (from agricultural to non-agricultural or urban land) to serve residential needs, infrastructure works, and production. Determining the construction land scale for each type of commune-level and village-level public works and services; scale and land indicators for each type of household such as: agricultural production households; small-scale industrial production households; commercial and service households in the entire commune.
d) Orientation for overall spatial planning of the commune: Orientation for organizing the system of commune centers, new residential areas, and renovating villages and hamlets. Determining the population scale, characteristics, and residential land needs for each new residential area and village or hamlet. Orientation for organizing the system of public works and services; determining the location, scale, and architectural orientation for commune-level and village-level public works and services. Orientation for organizing the spatial planning and architecture of new residential areas and existing villages and hamlets; specifying planning indicators and architectural orientation for each type of housing suitable to local characteristics. Orientation for organizing concentrated small-scale industrial production areas, craft villages, agricultural production and service areas. Orientation for organizing the combination of other functional zones in the commune in compliance with higher-level planning, sectoral planning, service functional zones supporting rural economic development (if any).
đ) Contents of the Regulation on architectural management of rural residential areas (integrated as prescribed in Article 13 of the Government’s Decree No. 85/2020/ND-CP dated July 17, 2020, detailing a number of articles of the Law on Architecture).
e) Land use planning: Planning of land types in the commune updated in accordance with the district-level land use planning. Determining the land area for development needs in 5-year and 10-year stages and main technical parameters for each type of land, specifically: agricultural land, construction land, and other land types. Aggregating the land use planning according to Appendix VIII of this Circular.
g) Technical infrastructure planning: Orientation for planning the construction of technical infrastructure works and technical infrastructure hubs within the commune. Determining the production-supporting infrastructure framework such as: intra-field roads, irrigation canals. Determining the location and scale of technical infrastructure works including: commune axis roads, inter-village roads, village axis roads, ground elevation, power supply, water supply and drainage, waste treatment, and cemeteries.
h) Proposing environmental protection solutions.
i) Forecasting prioritized investment programs and projects: Identifying prioritized investment programs and projects in the commune and implementation plans for each stage. Preliminarily forecasting the capital needs and resources for implementation.
k) Conclusions and recommendations.
3. Calculation appendices accompanying the explanatory statement (additional justifications, explanations, arguments for the explanatory statement, calculation data) and relevant legal documents.

Article 35. Contents of the task assignment dossier for detailed planning of rural residential areas
1. Types of detailed planning for rural residential areas:
a) Detailed planning for renovating or constructing new Commune Centers.
b) Detailed planning for renovating villages, hamlets, or constructing new residential areas and resettlement areas.
c) Detailed planning of service functional zones supporting rural economic development and other functional zones in the commune.
2. Drawings include: Location diagram, area relationships; map of the planning boundary at an appropriate scale.
3. The explanatory statement includes the following contents:
a) Stating the reasons, necessity, and basis for planning.
b) Location, boundary scope, planning scale; population scale (if any).
c) Requirements during the planning process: Assessing natural conditions and the current status of the planning area (regarding land, population, social infrastructure, technical infrastructure, etc.); Organizing the space, architecture, and landscape of public works, constructing new housing, greenery (including new construction and renovation); restricted construction zones, prohibited construction zones, conservation zones, management of valuable architectural works (according to the Law on Architecture 2019); Socio-economic and technical indicators for land, technical infrastructure, and social infrastructure of commune centers and centers of villages and hamlets, works and clusters of works in the service functional zones supporting rural economic development (if any); proposing environmental protection solutions.
d) List and number of dossier sets, implementation progress; specifying requirements for content, format, and stakeholders for collecting opinions on the planning. Total cost estimate for planning.

Article 36. Contents of the detailed planning dossier for rural residential areas

d) Solutions for organizing the architectural space, land use planning for public works, works in the service functional zones supporting rural economic development, rural housing (including new construction and renovation).

Section 5. PLANNING ADJUSTMENT DOSSIERS AND ARCHIVAL DOSSIERS
Article 37. Contents of dossiers for adjusting urban and rural planning
1. For overall adjustments to urban and rural planning:
The content and composition of the task dossier and project dossier for overall adjustments to planning are specified in Section 1, Section 2, Section 3 and Section 4 of Chapter II of this Circular.
2. For local adjustments to urban planning and functional zone construction planning, the content and composition of the dossier include:
a) Report of the planning organization agency to the competent authority approving the construction planning, clearly stating: Reasons and necessity for local adjustments to planning; contents of local adjustments to planning; analysis and clarification of the continuity and synchronization of the entire planning project and the socio-economic efficiency of local adjustments to planning; determining the planning indicators achieved after local adjustments to planning, with comparison to the approved planning indicators before proposing local adjustments; assessing the impact of local adjustments on the implementation of the approved planning; proposing measures to overcome new issues arising from local adjustments; roadmap and schedule for implementation according to the local adjustments to planning after being decided by the competent authority. The report must be accompanied by relevant legal documents and materials.
b) Drawings showing the contents including: location, scope of boundary and scale of the area for local adjustments; contents of local adjustments; determining the planning indicators achieved after adjusting the planning, with comparison to the approved planning indicators.
c) Draft document of the competent authority deciding on the local adjustments to planning.
Article 38. Archival dossiers
1. For planning tasks, the archival dossier includes:
a) Decision approving the task.
b) Explanatory statement accompanied by color A3-size printouts certified by the appraisal agency.
c) Files storing the entire dossier and relevant documents in portable document format (pdf) and in the formats of the software used to prepare the planning task dossier.
2. For planning projects, the archival dossier includes:
a) Decision approving the planning project
b) Explanatory statement, drawings and management regulations according to the planning project certified by the appraisal agency.
d) Files storing the entire dossier and relevant documents in pdf format and in the formats of the software used to prepare the planning project dossier.
3. For planning adjustments, the archival dossier includes:
a) Overall adjustments to planning: As specified in clauses 1 and 2 of this Article.
b) Local adjustments to planning: Decision approving local adjustments to planning; report on local adjustments to planning and drawings updating the contents of local adjustments; files storing the entire dossier and relevant documents in pdf format and in the formats of the software used to prepare the dossier for local adjustments to planning.
Chapter III IMPLEMENTATION ORGANIZATION
Article 39. Implementation clauses
1. This Circular takes effect from January 1, 2023.
2. Completely abolish the following Circulars:
a) Abolish Circular No. 12/2016/TT-BXD dated June 29, 2016 of the Minister of Construction regulating the task dossiers and planning projects for construction planning of regions, urban planning and construction planning of special-function zones.
b) Abolish Circular No. 02/2017/TT-BXD dated March 1, 2017 of the Minister of Construction guiding rural construction planning.
Article 40. Transitional provisions
a) After this Circular takes effect, the urban and rural planning tasks and projects being formulated, not yet completed must be reviewed and finalized in accordance with the provisions of this Circular before submitting for appraisal.
b) For urban and rural planning tasks and projects that have been appraised and are being submitted for approval, the task dossiers and project dossiers shall continue to comply with the provisions of Circular No. 12/2016/TT-BXD dated June 29, 2016 and Circular No. 02/2017/TT-BXD dated March 1, 2017.
c) For urban and rural planning that has been approved for tasks and is being organized for project formulation, the approved task dossiers do not need to be adjusted; the project dossiers must be reviewed and implemented in accordance with the provisions of this Circular before submitting for appraisal.
d) The abridged urban detailed planning project dossier and the abridged detailed construction planning project dossier specified in Articles 13 and 30 of this Circular shall be implemented after the effective date of the Decree amending and supplementing a number of articles of the Decrees under the state management of the Ministry of Construction.
Article 41. Implementation responsibilities
1. Organizations and individuals participating in the formulation, appraisal and approval of urban and rural planning are responsible for complying with the provisions of this Circular on the dossiers of tasks and projects for district planning, urban planning, construction planning of functional zones and rural planning.
2. The Department of Planning – Architecture under the Ministry of Construction, the Departments of Construction of provinces, the Department of Planning – Architecture of Hanoi City and the Department of Planning – Architecture of Ho Chi Minh City are the agencies responsible for guiding and inspecting the implementation of the provisions of this Circular.
3. During the implementation process, if there are any problems, organizations and individuals are requested to send their opinions in writing to the Ministry of Construction for consideration and resolution./.
